This  Policy applies to IPL and each of its wholly-owned subsidiaries other than those in the European Union and Turkey (which have their own privacy policies), and the expressions “we”, “us” and “our” are a reference, collectively and individually, to IPL and each of its wholly-owned subsidiaries.

1.                   Introduction

This Privacy Policy contains important information about:

2.                   How we comply with the law

We are subject to certain applicable laws governing data collection practices in the countries in which we operate. This Privacy Policy explains how we handle personal information in accordance with those applicable laws.

If we collect, store, use or process information from California residents we provide additional disclosures which are set out in Section 11 Jurisdiction Specific Disclosures.

“Personal information” is used in this Privacy Policy to refer to information or an opinion about an identified individual or an individual whose identity can reasonably be ascertained from the information, whether or not the information is recorded in a material form and whether or not the information is true.  Personal information also includes any sensitive personal information and credit information.

 

3.                   Collecting personal information

We will collect personal information in accordance with the law, usually directly from you.  We may collect personal information from third parties such as credit reporting bodies, third-party services providers, or our customers and suppliers.  For example, when running a promotion, we may collect personal information from a wholesale customer who submits an application on behalf of an end user of our products.

We only collect personal information that is necessary to conduct our business.  You are not required to supply any of the personal information that we request. However, if the personal information we request is not provided, we may not be able to provide you with the products or services requested, allow you access to our website or engage you to provide products or services to us. 

 

4.                   Information We Collect

We collect information, including personal information, about our customers, prospective customers, users of our products, contractors, suppliers, service providers, employees and prospective employees. This information may include:

·         date of birth;

·         place of work;

·         skills and expertise;

·         conduct at our worksites;

·         product preferences;

·         credit information and other financial details;

·         technical information about your internet connection, the equipment you use to access our websites, including usage details and IP addresses;

·         if you apply to work for us, employment information, including employment training participation or certifications;

·         details of your visits to and usage of our website including traffic data, logs, and other communication data and the resources that you access and use on the website;

·         information about your online activities over time and across third-party websites or other online services (behavioral tracking); and

·         login information such as username, password, and security questions.

 

The types of personal information that we collect will depend on how you interact with us. For example, your personal information will be collected when you purchase products, fill in an application form, request information or submit a complaint; and it may be collected when you visit this website or one of our worksites.  For example, we use in-vehicle management systems (IVMS) on selected vehicles at some of our work sites to monitor vehicle safety to reduce the risk of workplace incidents and accidents.  The IVMS can make video and sound recordings within the vehicle cabin and video recordings of the internal and external environment including other vehicles, as well as recording data about driving behaviour.

We may also generate new personal information from time to time (e.g. reports or analysis) based on the personal information we hold about you.

 

5.                   Collecting sensitive personal information

We may also collect more sensitive personal information, including information about a person’s racial or ethnic origins, political opinion, membership of a political, professional or trade association, religious beliefs or affiliations, philosophical beliefs, membership of a trade union, sexual orientation or practices, criminal record, genetic information or health information.

We will only collect, use or disclose such sensitive personal information about you where we are permitted by applicable laws, we need the information for one of our functions or activities, and we have obtained your consent or are legally required to process the information.

 

6.                   Security and Storing information

We store the information we collect on electronic servers in various locations around the world (which may be outside the country where you live) at our own facilities and with the assistance of service providers. We will take reasonable steps to store personal information in a secure environment to protect it from misuse, unauthorised access, modification or disclosure.  We will also take reasonable steps to securely destroy or de-identify personal information when it is no longer required for the purposes for which we collected it or for legal requirements.

However, no network, including the internet, is entirely secure. Accordingly, we cannot be responsible for the loss, corruption or unauthorised acquisition of your information you provide via the internet, including information provided to this website, or for any resulting damage.

We will use personal information only for the purpose for which it was collected or for related purposes permitted by law. For example, we use the information we collect to deliver our products and services to you. We may also use such information to promote or advertise our products and services. If you don’t want to receive direct marketing messages from us, you can ask to opt out at any time by contacting us. We will not sell, rent or trade your personal information or share your information for cross contextual behavioral marketing without your consent.

In the normal course of our business operations, we may disclose your information to related bodies corporate, regulators and other companies engaged to perform services for us, including consultants, IT and internet service providers.  We may disclose your information to a buyer or other successor in anticipation of or in connection with a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the IPL’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by the IPL is among the assets transferred. We will use reasonable efforts to require any person or company to whom we disclose personal information to restrict their use of such information to the purposes for which it has been provided and not to disclose that information to others.  However, except as required under law, we will not be responsible for any damage to you caused by the failure of unaffiliated third parties to honour their privacy obligations to us.

As some of our related bodies corporate and service providers are located overseas, information provided to us may be located or stored in a country outside the country in which it was collected.    Australian personal information is processed and stored in IT systems that reside in Australia or USA.  North American personal information is processed and stored in IT systems that reside in USA or Australia.  Canadian personal information is processed and stored in IT systems that reside in Canada, USA, or Australia.  Mexican personal information is processed and stored in IT systems that reside in Mexico, USA, or Australia.  Chilean personal information is processed and stored in IT systems that reside in Chile or USA.  Indonesian personal information is processed and stored in IT systems that reside in Indonesia, USA, or Australia.  Some countries may not provide the same level of protection of your personal information as the country in which your personal information was collected. 

We share your information with the following categories:

  • ·         service providers to carry out your request; or
  • ·         service providers to carry out out-sourced business processes, such as credit checks and credit reporting;
  • ·         marketing and advertising providers to provide you with information you may want.

We maintain appropriate safeguards to protect your personal information from accidental, unlawful or unauthorised access, disclosure or use.  Examples of these controls include: access to personal information is controlled through access and identity management systems; internal confidentiality and information security policies that require personal information to be kept secure at all times; and maintaining an ongoing security program where we invest in cyber-security.

Accessing, Correcting, or Updating Your Information

We will take reasonable steps to ensure that the personal information we collect, store or use is accurate, complete and up-to-date.  You may access personal information that we hold about you and where appropriate you may request that it be corrected. If you wish to review your personal information please contact the Privacy Officer at the relevant address provided in Section 13 below.  We will allow access or make the correction unless we consider the law permits or requires us to withhold the information, or not make the correction.

There is no charge for requesting access to personal information but we may require a person making such request to meet our reasonable costs in providing the access.  We will inform you of such costs before charging you.  

 

Do Not Track Signals

Some web browsers (including Safari, Internet Explorer, Firefox and Chrome) incorporate a “Do Not Track” (“DNT”) or similar feature that signals to websites that a user does not want to have his or her online activity and behavior tracked. If a website that responds to a particular DNT signal receives the DNT signal, the browser can block that website from collecting certain information about the browser’s user. Not all browsers offer a DNT option and DNT signals are not yet uniform. For this reason, many digital service operators, including IPL, does not recognize or respond to DNT signals.

 

8.                   Links to Other Websites

Our website may contain links to other websites that are not owned or operated by us.  We are not responsible for the privacy practices of those websites, or for the content, products, or services provided by, or contained on, those websites. We recommend you review the privacy notices of other third party websites, applications, and/or services applications before authorizing a third-party access to your data.

 

9.                   Credit reporting (Australia Only)

If you apply for credit from us, or are the proposed guarantor for another person, we may request a credit report about you from a credit reporting body.  These credit reports contain information which assists us to assess your application for credit or suitability to act as guarantor.  The law restricts the purpose for which we can access and use this information.

We may combine the information obtained from Veda with information we already hold about you.  We will use information sourced from Veda (possibly combined with information we already hold) for several purposes, including:

·         As required by relevant laws, regulations, codes of practice and payment systems.

We collect, manage and use credit information in the same way as we manage all personal information.

As you navigate through and interact with our website, we may use automatic data collection technologies, or other innovative technologies as they come out, to collect certain information about your equipment, browsing actions, and patterns, including:

·         details of your visits to our website, including traffic data, location data, logs, and other communication data and the resources that you access and use on the website; or

·         information about your computer and internet connection, including your IP address, operating system, and browser type.

The information we automatically collect is statistical data and may include personal information. It helps us to improve our website and to deliver a better and more personalized service, including by enabling us to:

Third Party Use of Automated Data Tracking Technologies

11.               Children Under the Age of 16 (USA Only)

If we learn we have collected or received information from a child under 16 without verification of parental consent, we will delete that information.
